Redistricting update: Delbert wins (Order included).

Today was a big day for Delbert as the federal three-judge panel ruled 2011 state elections will run under the current lines. The court looked at what the NAACP, Republicans, Democrats, Governor, and everyone else submitted, said thank you very much, then agreed with Secretary of State Delbert Hoseman:

"All of the parties acknowledge that shifts in population, reflected in the 2010 census, have resulted in the malapportionment of Mississippi’s existing legislative districts. Generally speaking, the parties have presented us with three options. The Democratic Party and others ask us to adopt as an interim remedy the respective plans passed this year by the House and the Senate, but not adopted by the full Legislature. The Republican Party and others agree that a remedy for malapportionment should be imposed, but they ask us to appoint an expert to draw a new plan, or to use the new plan that they have proposed. Third, the Secretary of State and others assert that it is premature for this Court to impose any remedy, because neither the Mississippi Constitution nor the United States Constitution requires the Legislature to reapportion itself until next year. We agree with the Secretary of State’s position that imposition of a remedy is premature and allow the 2011 legislative elections to proceed under the present districts."

Big win for Delbert as the Court gives the legislature additional time to come to an agreement on redistricting The opinion further states the injury has not yet taken place and there is no need at this time for federal intervention. This was a huge smackdown of Andy Taggart, Terry Burton, Phil Bryant,the Governor, and the crack legal team of Wallace & Seale. Contrary to Cottonmouth's assertions this was not a huge win for the Democrats as their plans were geared towards protecting incumbents. There will be more races in play.

Delbert wins because Delbert was right. This time at least. He argued for following the law and the Judges agreed. Can't believe Cottonmouth trying to claim this as a win for the Dems because it is exactly opposite of what they were fighting for, betting on, and wanting to see happen. As to the Governor/Phil/GOP its a loss, but not a big one because it does give the result of not employing the Reynolds/McCoy plan. They argued for the judges to draw a plan - and while they didn't get that the status quo was their secondary choice.

Burton (along with his Hospital Assn paid lawyer Taggert) lost big. Just as did the other Dems. Assume he won't be in charge of the redistricting process in 2012.

Status quo prevails for the most part...Rita Martinson remains a House Seat not a Senate contender.
The hats in the ring for Senate will shake, rattle and roll, with some pulling out and more going in.
A dozen business days left to file..who else will run against Rita? Who else will jump in Senate race? And who will the "Madison Mafia" support?

"Smackdown OF" is correct. The GOP argued existing lines were unconstitutional. Were they not the ones taking this to federal court in the first place?

Dems did lose too, but they are less hurt by the status quo than the GOP is. It's not like they were expecting to win the Senate.

I know many if not most of the Republican players involved in this case. Andy Taggart, Mike Wallace and the Governor are very smart men who wanted a specific outcome. Delbert is just as smart as those guys, and merely wanted to follow the law.

Phil is just along for the ride. He can't hold the jockstrap for any of the 4 above. Yet, he is still better than anything the Dems have to offer

The real winner here were the people, the state constitution and the MS TEA PARTY.

The court essentially adopted the theory and language of their fried of the court brief as researched and drafter by Russ Latino and Richard Wilbourn.

3:46 - The 'one man, one vote' rule still applies. The USSC in adopting the rule stated that a state must have a plan in place for redistricting and that it should 'at a minimum' redistrict every ten years. MS, as noted by the 3 judge panel, last redistricted in 2002. They adopted a plan (section 245 of the MS constitution) that said they would redistrict every ten years beginning in 1982. The judges properly ruled that redistricting by 2012 would be in line with the MS Constitution and that the provisions of the MS Constitution fit within the 'one man, one vote' rule. So the judges ruled that MS should follow the MS Constitution and the NAACP and the Dems will just have to live with it. (It should be noted that Section 245 of the Constitution was passed when the Dems were over 90% of the MS House and the MS Senate.)

If you read the order.... or just the executive summary of the order you will see reference to the Russell case. Basically, once every ten years is good enough for the courts. Districts are malaportioned the day they are drawn. Section 254 calls for redistricting every 10 yrs beginning with the year after the census data is available.

I think Secretary Hosemann was spot on in his argument, but it was Russ Latino's brief that carried the day on this. The judges had Delbert's arguments when they issued their "inclination" order, but Russ put another slant on it that got through to them. Thanks, Russ...it may be a long time before anyone has such a quiet impact on the future of our state. Bill Billingsley

Despite his missteps along the way some credit should be afforded to Phil Bryant. He stopped the McCoy-Reynolds plan and withstood the backstabbing leaks to the media by Burton. It wasn't elegant nor always well thought out but he did put enough obstacles in the way that led to the eventual derailment of the House plan.

You're right about Phil Bryant deserving a lot of credit for starting this chain of events and seeing it trhough to the end. He took a huge political risk for conservativism, and won.

Delbert handled the mess? Delbert's attorneys were sucking big wind and Donkeycrat dicks until the Tea Party Amicus Brief arrived to save the day. Yes, give Delbert credit for holding the line until the big guns arrived for the decisive battle. But the credit is no way solely his.

Phil is a joke and really showed his true colors during redistricting. Accusing a judge of earwigging? Really? Do y'all really want this guy representing our state? I wish that same judge could permanent place gag order on old Phil.

Phil Bryant doesn't take " a huge political risk" for anything or anybody.

I just don't know how he continues to fool so many people. Doesn't anyone recognize his canned remarks when he makes a speech?

His speeches are a string of catch phrases that have already " played".

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).


Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.


In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required.
