Federal court dismisses Madison County lawsuit.

U.S. District Court Judge Louis Guirola, Jr. dismissed Madison County's lawsuit seeking to extend qualifying deadlines for candidates to June 1. I don't have time to write a full analysis but it appears the court said Madison lacked standing, there was no actual injury, and any discussion of making candidates run under new plans with the old qualifying dates were thus moot. It appears Madison County candidates will thus run under the current lines for the 2011 election. The ruling is posted below.

This means Tim Johnson, Rudy Warnock and Gerald Steen all go down together, and maybe Madison County can be rid of these sleazeballs.

I would like to add Karl Banks list of sleazeballs too.

@ Micah: Agree

Nah--we won't be rid of them. We'll elect some more just like 'em. Sad but true.

8:48 I don't agree. The more people pay attention the better it can get. Just look at Rankin County. It was a cesspool over there until they threw all their county supervisors out of office and started paying attention. Madison County is getting there.

8:54--You do remember that this current bunch presented themselves as reform candidates when they were elected? I wish that you were right, but the voters in Madison Co. are the people P.T. Barnum had in mind in that famous quotation, at least when it comes to politics. They are very easily duped.

Unfortunately, all of us pay the price for our fellow citizens' inattention to the political realities of our county. Hide and watch. Four years will pass and we'll have new supes, but no change.

And Rankin County is still a cesspool. They've just learned to be more discreet.

not so fast. if DOJ preclears before June 2nd, better than 90% chance election will be under new lines. new plan submitted 5/27, DOJ response req'd within 60 days and highly unlikely new lines won't be approved. stay tuned.

Read the order, 10:02. The last paragraph on page 17 finishing up on page 18 makes it clear that the plan submitted to DOJ can't be used because it wasn't approved before the filing deadline. Further, the judge could have easily stated the opposite in his order if that was his intent. I'll stay tuned, but it's not likely that even Tim will risk violating an order from a federal judge. 10:02- The Justice Department knows how to read a court opinion, even if you don't. This opinion slams the door on any district lines that did not exist before March 1st.

if DOJ preclears by June 2nd, judicial relief will, without question, remedy under-represented Madison residents' 14th Amendment rights and no longer be speculative. read pages 9 and 10 more carefully. there's a reason dismissal was without prejudice.

Wrong. The prospect of DOJ relief was only raised as a standing issue. It wasn't even enough of a possibility to keep the plaintiffs in court. This opinion clearly says candidates will run under the old lines this year. The counties did not have enough time this year to enact a reapportionment plan. A board of supervisors "must have adequate time to formulate a redistricting plan and obtain preclearance from the Department of Justice," and the counties didn't have enough time. Therefore, DOJ approval is irrelevant. Old lines.

8:48 is correct. The names change but the end product remains the same. That will be the case as long as the good ole boy long time Madison Countians continue to dominate the ballots.

Anonymous said...

7:48 As a long time Madison Countian myself, I can tell you there are very few of us left. Most of the voters now are new and have moved here from somewhere else.

When I said dominate the ballots, I meant the list of names on the ballots. True that there are many new people in Madison County, however, those people aren't moving here to pursue political careers, so you end of with the lifetimers with political ambition running for everything..the Johnsons/Banks...constable/judge/
mayor of Gluckstadt etc.

Choke on it, Tim Johnson, you dirty RINO piece of shit. His last desperate act -- to save Paul Griffin and Karl Banks -- has failed.

That piece of garbage should be horse-whipped.

J. Kev said...

In case there was some ambiguity, Tim Johnson is a disgusting human being who should be run out of the Republican Party. He's spent the last 7 years in a voting coalition with two effing Democrats.

What a scumbag. Piece of shit should die in a house fire. Criminal.

Kev, that is very crude and uncalled for. I'm not in favor of Tim Johnson in any form or fashion. But I'm disgusted by those words. He has a family, for goodness sakes!

Anonymous said...

J. Kev how do you really feel about Elvis? hahahahahahaha

J. Kev said...

Julia --

He's a rude, uncalled for piece of garbage. I don't give a damn for his family or his feelings. Every one of them can die in a fire for all I care.

He's a lying scumbag who belongs in jail. And I'll say it to his face.

Anderson said...

J Kev also thinks that "Democrats," his code term for black people, are "the stupidest people on the planet." Possibly he wishes for them to die in house fires too.

J. Kev said...

No, Mr/Ms Anderson. "Democrats" is code for members of the Democrat Party.

The kicked dog yelps the loudest.

J. Kev, did you vote for Tim Johnson or Marc Sharpe back when Johnson and company slithered into office? Just wonderin' :-)

Micah Gober said...

I'm sorry to say I voted for Tim Johnson....Never again....

"J.Kev" Broughton is a lawyer in Canton. His biggest claim to fame is filing a lawsuit in the wrong court, thus costing his client the case. "Chancery" vs. "Circuit" is an easy mistake to make UNLESS YOU'RE A LAWYER.

Anonymous said...

I am certainly not a fan of Tim Johnson! However, I think Mr. Broughton needs anger management classes or maybe counseling as a guest of our state mental hospital in Rankin County. I would think a "real attorney" would know better or at least have enough class not to voice feelings such as these in public.

Anderson said...

J. Kev, in the Canton-vs.-Nissan thread:

The sheer gall of it still astounds me. Until I remember that the city of Canton is 90% uh, Democrat. They don't care that the Blackmons hold them in contempt; all they know is that it's "their turn" to run the City.

Because the average IQ for those uh, Democrats won't even sniff room temperature. They are at a level of stupidity that's hard to fathom. I think they're the dumbest people on the planet.

I would have to be one of the dumbest people on the planet not to find a racial slur here.

While I am no fan of Tim 'Elvis' Johnson, and also believe that he should be serving some time in jail for his actions in public office, I am not about wish for his, or his families, death(s). I do believe very strongly that he is a dips#!t and so pompass that he will hang himself given enough rope! The voters need to make sure that he is about to rap up his final year in public office . . . EVER!!! Please remember that friends shouldn't allow friends to drive drunk and they also shouldn't allow their stupid friends to vote.

Madison County officials say they will ignore a federal judge's order to use existing district lines in the 2011 elections and will attempt to get Justice Department approval of their controversial reapportionment plan.

Trollfest '09

Trollfest '07 was such a success that Jackson Jambalaya will once again host Trollfest '09. Catch this great event which will leave NE Jackson & Fondren in flames. Othor Cain and his band, The Black Power Structure headline the night while Sonjay Poontang returns for an encore performance. Former Frank Melton bodyguard Marcus Wright makes his premier appearance at Trollfest singing "I'm a Sweet Transvestite" from "The Rocky Horror Picture Show." Kamikaze will sing his new hit, “How I sold out to da Man.” Robbie Bell again performs: “Mamas, don't let your babies grow up to be Bells” and “Any friend of Ed Peters is a friend of mine”. After the show, Ms. Bell will autograph copies of her mug shot photos. In a salute to “Dancing with the Stars”, Ms. Bell and Hinds County District Attorney Robert Smith will dance the Wango Tango.

Wrestling returns, except this time it will be a Battle Royal with Othor Cain, Ben Allen, Kim Wade, Haley Fisackerly, Alan Lange, and “Big Cat” Donna Ladd all in the ring at the same time. The Battle Royal will be in a steel cage, no time limit, no referee, and the losers must leave town. Marshand Crisler will be the honorary referee (as it gives him a title without actually having to do anything).

Meet KIM Waaaaaade at the Entergy Tent. For five pesos, Kim will sell you a chance to win a deed to a crack house on Ridgeway Street stuffed in the Howard Industries pinata. Don't worry if the pinata is beaten to shreds, as Mr. Wade has Jose, Emmanuel, and Carlos, all illegal immigrants, available as replacements for the it. Upon leaving the Entergy tent, fig leaves will be available in case Entergy literally takes everything you have as part of its Trollfest ticket price adjustment charge.

Donna Ladd of The Jackson Free Press will give several classes on learning how to write. Smearing, writing without factchecking, and reporting only one side of a story will be covered. A donation to pay their taxes will be accepted and she will be signing copies of their former federal tax liens. Ms. Ladd will give a dramatic reading of her two award-winning essays (They received The Jackson Free Press "Best Of" awards.) "Why everything is always about me" and "Why I cover murders better than anyone else in Jackson".

In the spirit of helping those who are less fortunate, Trollfest '09 adopts a cause for which a portion of the proceeds and donations will be donated: Keeping Frank Melton in his home. The “Keep Frank Melton From Being Homeless” booth will sell chances for five dollars to pin the tail on the jackass. John Reeves has graciously volunteered to be the jackass for this honorable excursion into saving Frank's ass. What's an ass between two friends after all? If Mr. Reeves is unable to um, perform, Speaker Billy McCoy has also volunteered as when the word “jackass” was mentioned he immediately ran as fast as he could to sign up.

In order to help clean up the legal profession, Adam Kilgore of the Mississippi Bar will be giving away free, round-trip plane tickets to the North Pole where they keep their bar complaint forms (which are NOT available online). If you don't want to go to the North Pole, you can enjoy Brant Brantley's (of the Mississippi Commission on Judicial Performance) free guided tours of the quicksand field over by High Street where all complaints against judges disappear. If for some reason you are unable to control yourself, never fear; Judge Houston Patton will operate his jail where no lawyers are needed or allowed as you just sit there for minutes... hours.... months...years until he decides he is tired of you sitting in his jail. Do not think Judge Patton is a bad judge however as he plans to serve free Mad Dog 20/20 to all inmates.

Trollfest '09 is a pet-friendly event as well. Feel free to bring your dog with you and do not worry if your pet gets hungry, as employees of the Jackson Zoo will be on hand to provide some of their animals as food when it gets to be feeding time for your little loved one.

Relax at the Fox News Tent. Since there are only three blonde reporters in Jackson (being blonde is a requirement for working at Fox News), Megan and Kathryn from WAPT and Wendy from WLBT will be on loan to Fox. To gain admittance to the VIP section, bring either your Republican Party ID card or a Rebel Flag. Bringing both and a torn-up Obama yard sign will entitle you to free drinks served by Megan, Wendy, and Kathryn. Get your tickets now. Since this is an event for trolls, no ID is required. Just bring the hate. Bring the family, Trollfest '09 is for EVERYONE!!!

This is definitely a Beaver production.
